In this Privacy Policy, "Company," "we," "us," and "our" refer to Harvey Perle LTD and Perle & Co.; "you" and "your" refer to any person who visits the Website, contacts us, submits information to us, requests a quote, applies for or purchases a policy, receives services from us, or otherwise interacts with us.
This Privacy Policy is legally binding to the fullest extent permitted by law. By accessing or using the Website, submitting information to us, requesting information, scheduling an appointment, receiving communications from us, applying for or purchasing any insurance policy, product, or service, or otherwise interacting with us, you agree to this Privacy Policy. If you do not agree, do not use the Website or our services. This Privacy Policy does not limit any privacy rights you may have under applicable law, and where applicable law requires separate consent, authorization, or notice, we will rely on that separate consent, authorization, or notice.
The Website and our services are intended for individuals located in the United States and in states where we are authorized to conduct business. We do not intentionally market, sell, or provide services outside the United States or in any jurisdiction where we are not authorized to do business. This Privacy Policy applies to personal information we collect through the Website, phone calls, email, text messages, online forms, meetings, insurance applications, policy servicing, marketing communications, third-party service providers, advertising and analytics tools, and other interactions with us. It does not apply to websites, platforms, carriers, plan providers, payment processors, social media platforms, marketing platforms, or other third parties that we do not own or control.
We may collect personal information directly from you, automatically through the Website or communications technologies, from insurance carriers or other business partners, from service providers, from advertising and analytics partners, from social media platforms, and from other sources permitted by law.

7. Marketing and advertising information, such as your communication preferences, email subscription status, advertising interactions, ad campaign source information, lead source, audience or segment information, and information collected through advertising pixels, tags, cookies, web beacons, or similar technologies.
8. Information from third parties, such as information from insurance carriers, plan providers, lead or referral partners, marketing platforms, analytics providers, advertising platforms, social media platforms, payment processors, customer relationship management providers, technology vendors, AI-enabled tools, automation providers, or other service providers and business partners.
We may combine information collected from different sources where permitted by law.
We may use personal information for business, operational, legal, compliance, and commercial purposes, including to:
1. respond to your inquiries, quote requests, applications, appointment requests, and other communications;
2. evaluate coverage options, provide quotes, assist with insurance or related applications, enroll you in policies or plans, service policies, renew policies, maintain records, and provide related products or services;

4. verify identity, confirm information, process payments, manage billing, and maintain transaction records;

6. send newsletters, marketing emails, promotional messages, event information, reminders, or other communications where permitted by law;
7. measure, improve, and personalize the Website, communications, marketing campaigns, and services;
8. track advertising traffic, measure campaign performance, attribute leads, understand how users interact with our Website and advertisements, create or use marketing audiences, and provide, measure, or improve tailored advertising;
9. detect, investigate, prevent, and respond to fraud, security incidents, misuse, unauthorized activity, legal claims, and other harmful or unlawful activity;
10. comply with laws, regulations, licensing obligations, carrier requirements, plan requirements, Medicare/CMS requirements, state insurance requirements, subpoenas, court orders, governmental requests, and other legal or regulatory obligations;
11. enforce our rights, agreements, policies, and terms; and
12. conduct internal administration, audits, training, recordkeeping, reporting, dispute resolution, risk management, corporate transactions, and other legitimate business purposes.
We may use artificial intelligence, machine learning, automated, or AI-enabled tools as part of our ordinary business operations, similar to the way we use email, phone, customer relationship management, document management, transcription, scheduling, analytics, and other technology tools. These tools may help us draft, summarize, organize, analyze, translate, transcribe, route, review, or respond to communications and documents; maintain records; support customer service; improve our Website, marketing, and internal workflows; assist with compliance, fraud prevention, security, and administrative tasks; and otherwise operate our business.
When we use AI-enabled tools, personal information may be processed by us or by third-party service providers that provide those tools. Depending on the context, this may include contact information, communications, notes, documents, policy or application information, health/Medicare/insurance information, financial information, identifiers, Website activity, or other information described in this Privacy Policy. We treat AI-enabled tools and providers as technology and service providers, and we use them subject to applicable agreements, privacy terms, confidentiality, security, and data-handling practices.
We do not intend to use Social Security numbers, full payment card numbers, health-related information, Medicare-related information, insurance application information, policy records, or other sensitive client or prospect information to train publicly available AI models. We also do not intentionally make personal information publicly available through AI tools. However, AI tools may process information to provide, secure, maintain, troubleshoot, or improve the tool as permitted by applicable provider terms and law.
We may use AI-assisted outputs to support our work, but AI tools do not replace professional judgment. We do not use AI tools as the sole basis for final decisions about insurance eligibility, policy issuance, underwriting, claims, coverage, rates, legal rights, or other consequential decisions. Insurance carriers, plan providers, and other third parties may have their own technology, AI, automation, underwriting, eligibility, or decision-making practices, which are governed by their own privacy notices and legal obligations.
If applicable law requires additional notice, opt-out rights, human review, appeal rights, or other disclosures for a particular use of AI, automated decision-making, profiling, or similar technology, we will provide those rights or notices to the extent required by law.
We may disclose personal information to the following categories of recipients:
1. Insurance carriers, plan providers, administrators, brokers, agencies, field marketing organizations, independent marketing organizations, enrollment partners, and other insurance or benefits partners as needed to evaluate, quote, apply for, enroll in, service, renew, or maintain policies, plans, and related products or services.
2. Service providers and vendors that help us operate our business, such as website hosting providers, cloud providers, customer relationship management providers, email and marketing platforms, appointment scheduling tools, payment processors, text messaging providers, call or communications tools, document storage providers, IT/security providers, analytics providers, customer service providers, AI-enabled tools, automation providers, and administrative support providers.
3. Marketing and advertising partners, including third-party platforms and tools used to measure advertising traffic, track conversions, improve campaigns, understand visitor activity, and provide or evaluate tailored advertising.
4. Payment processors and financial service providers that process payments or transactions. We do not store full payment card numbers.
5. Professional advisers, such as attorneys, accountants, auditors, consultants, compliance professionals, and other advisers.
6. Government agencies, regulators, law enforcement, courts, insurance departments, Medicare/CMS-related entities, tax authorities, and other parties where we believe disclosure is required or appropriate to comply with law, respond to legal process, protect rights, investigate fraud or security issues, or enforce our agreements and policies.
7. Business transaction parties in connection with an actual or proposed merger, acquisition, financing, sale, transfer, reorganization, bankruptcy, dissolution, or other transaction involving all or part of our business or assets.
8. Other parties with your direction, authorization, or consent, or as otherwise permitted by law.
Because our services may involve insurance, Medicare, health, care-planning, financial, payment, and identity information, we may collect and disclose sensitive information when it is reasonably necessary for quotes, applications, enrollment, policy servicing, compliance, payments, tax, legal, or related business purposes. This may include Social Security numbers, Medicare-related identifiers, health or prescription information, policy information, beneficiary information, financial information, and similar information.
We do not use Social Security numbers, policy records, Medicare/health information, or full payment card information for targeted advertising. We may disclose such information to carriers, plans, administrators, regulators, service providers, and other parties as described in this Privacy Policy when needed to provide or service policies, comply with legal or regulatory obligations, protect rights, or perform legitimate business purposes.
Depending on the product, carrier, plan, or relationship involved, additional privacy notices, authorizations, insurance rules, Medicare/CMS requirements, financial privacy rules, HIPAA-related requirements, state insurance laws, or carrier/plan privacy practices may apply. If a separate application, carrier notice, plan notice, authorization, or agreement applies to specific information, that separate document may also govern the collection, use, disclosure, retention, and protection of that information.
We and our service providers, analytics providers, and advertising partners may use cookies, pixels, tags, web beacons, software development kits, server logs, email tracking technologies, conversion tracking tools, remarketing tools, and similar technologies. These technologies may collect or receive information such as IP address, device identifiers, browser type, operating system, pages visited, links clicked, referring website, advertising source, campaign identifiers, conversion events, form interactions, email opens, email clicks, and other browsing or interaction information.
We use these technologies to operate the Website, remember preferences, secure the Website, understand how visitors use the Website, measure email and advertising performance, track advertising traffic, attribute leads, improve campaigns, create or measure marketing audiences, and provide, measure, or improve advertising.
We do not sell personal information for money. We do not rent or trade client policy records, Social Security numbers, Medicare/health information, or full payment card information to marketers. However, our use of certain advertising, analytics, conversion-tracking, and remarketing technologies may be considered "targeted advertising," "sharing," or a "sale" under some state privacy laws, even when no money is exchanged. Where required by applicable law, you may opt out of such activity by using any privacy choices tool we make available, adjusting your browser or device settings, using opt-out controls provided by the relevant advertising platforms, or contacting us using the contact information below.
Most browsers accept cookies by default but allow you to block or delete cookies. Disabling cookies may affect Website functionality or prevent certain features from working properly. We currently may not recognize every browser-based "Do Not Track" signal. If applicable law requires recognition of a specific opt-out preference signal or universal opt-out mechanism, we will honor it to the extent required by law and technically feasible.
We may use third-party service providers, such as Mailchimp or other email, SMS, phone, customer relationship management, marketing, or communications platforms, to send and manage communications. These providers may process contact information, communication preferences, message content, open and click activity, subscription status, suppression lists, and related information on our behalf and according to their own applicable terms and privacy practices.
Email Marketing. If you receive marketing emails from us, you may opt out by clicking the unsubscribe link in the email or by contacting us. Unsubscribing from marketing emails does not necessarily stop transactional, relationship, policy, service, legal, or administrative communications.
SMS/Text Messages. If you authorize us or our service providers to contact you by text message, we may send text messages for service, appointment, reminder, policy, marketing, or other purposes permitted by law. Message and data rates may apply. Where available, you may opt out by replying STOP, request help by replying HELP, or contact us using the contact information below. Opting out of marketing texts does not necessarily stop transactional, relationship, policy, service, legal, or administrative messages where permitted by law.
Phone Calls and Mail. If we contact you by phone or physical mail for marketing purposes, you may opt out by contacting us. We may still contact you for transactional, relationship, policy, service, legal, or administrative purposes where permitted by law.
Depending on your state of residence and subject to applicable law, you may have some or all of the following rights with respect to your personal information:
1. the right to confirm whether we process your personal information;
2. the right to access or obtain a copy of certain personal information;
3. the right to correct inaccurate personal information;
4. the right to request deletion of certain personal information;
5. the right to obtain a portable copy of certain personal information;
6. the right to opt out of the sale of personal information, targeted advertising, or certain profiling activities, where applicable;
7. the right to limit or withdraw consent for certain uses of sensitive personal information, where applicable;
8. the right to appeal a denied privacy request, where applicable; and
9. the right not to be discriminated against for exercising privacy rights provided by law.
These rights are not absolute and may be subject to exceptions. For example, we may deny or limit a deletion request if we need to retain information to provide services, service or maintain policies, complete transactions, comply with carrier, legal, tax, insurance, Medicare/CMS, regulatory, accounting, audit, security, fraud prevention, dispute, or recordkeeping obligations, protect rights, or otherwise use the information as permitted by law.
Even where a particular state privacy law does not require us to provide a specific right, we may consider reasonable requests in our discretion. To submit a privacy request, contact us using the information in the "How to Contact Us" section below. We may need to verify your identity before processing your request. If you submit a request through an authorized agent, we may require proof of authorization and may require you to verify your identity directly with us. If you wish to appeal a decision, please contact us and include "Privacy Appeal" in your request.
We retain personal information for as long as reasonably necessary or permitted for the purposes described in this Privacy Policy, including to provide and service policies, maintain client, prospect, and business records, comply with laws and regulations, meet carrier, plan, Medicare/CMS, insurance, tax, accounting, audit, and legal requirements, resolve disputes, protect rights, enforce agreements, prevent fraud, maintain security, and operate our business.
Our retention periods vary depending on the type of information, the reason it was collected, legal and regulatory requirements, carrier or plan requirements, the status of our relationship with you, and our business needs. We generally use the following criteria to determine how long to retain personal information:
1. Insurance, policy, application, client, prospect, Medicare, health, financial, identity, and Social Security number records may be retained for the duration of the application process, policy, client or prospect relationship, and thereafter for as long as we reasonably determine the information may be needed for policy servicing, future coverage assistance, renewals, compliance, audit, legal, regulatory, dispute, fraud-prevention, historical recordkeeping, or other legitimate business purposes, unless a shorter or longer period is required by law.
2. Payment card information is handled by third-party payment processors. We do not store full payment card numbers. We may retain limited payment records, receipts, transaction confirmations, tokenized payment details, or related billing information as needed for business, tax, accounting, legal, and compliance purposes.
3. Marketing contact information may be retained until you opt out or until we no longer need it. We may retain limited suppression-list information to honor opt-out requests and avoid sending marketing communications after an opt-out.
4. Website analytics, cookie, advertising, and email engagement information is retained according to our business needs and the settings or retention practices of the third-party platforms and service providers involved.
5. Legal, security, fraud-prevention, dispute, and compliance records may be retained for as long as necessary to protect our rights, comply with obligations, and maintain business records.
We may delete, de-identify, archive, or retain information in accordance with our business and legal needs and ordinary recordkeeping practices. When we delete information, copies may remain for a limited period in backups, archives, logs, or third-party systems until deleted through ordinary retention and backup processes. We cannot control the retention practices of third parties that are not our service providers.
We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, disclosure, alteration, or destruction. These safeguards may include access controls, secure systems, vendor management, confidentiality obligations, data handling procedures, and other security measures appropriate to the nature of the information.

The Website and our communications may include links to third-party websites, social media platforms, payment processors, scheduling tools, advertising platforms, carrier websites, plan websites, or other third-party services. We do not control third-party privacy practices, security practices, content, or policies. When you interact with a third party, that third party's privacy policy and terms may apply.
The Website and our services are intended for adults and are not directed to children under 18. We do not knowingly collect personal information from children under 18. If you are under 18, do not use the Website or submit personal information to us. If we learn that we have collected personal information from a child under 18, we will take reasonable steps to delete it, subject to applicable legal and recordkeeping requirements.
